TERMS AND CONDITIONS OF SERVICE
GENERAL TERMS:
Fun Fit Adventures Cape Town referred to as FFACT.
All terms and conditions are subject to South African Law and Jurisdiction.
FFACT reserves the right to refuse to transport or continue to transport, any passenger(s) or their luggage or goods provided that such refusal shall not result in any unfair discrimination. FFACT reserves the right to refuse transport of any minor child or major person in its sole discretion and shall not be liable for and is indemnified against any loss or damage occasioned by such refusal.
Should you have a complaint in respect of FFACT, you should inform FFACT as soon as possible after the incident. FFACT will not consider any complaints raised more than 7 days after the incident.
Passengers with special needs, including passengers with medical conditions and disabilities, are required to inform FFACT before they travel with FFACT.
Passengers with any medical condition, whether chronic or not, are advised to consult a medical practitioner prior to departure.
No smoking of cigarettes, vapes, e-cigarettes or anything similar is permitted in our vehicles.
No drinking or eating is permitted in our vehicles. Client will be held responsible for any damage caused to the vehicle, its fittings, and equipment.
Please note that in the event of spillages or soiling of the interior, valet fees will be raised and will be deducted from the deposit.
Services listed as ‘Exclusions’ will be quoted on request and billed accordingly on acceptance of the quotation (refer to the notes provided in the quotation).
All Toll Fees and fuel included.
Entrance fees are included.
Services provided by a Service Provider will be subject to the Service Provider’s terms and conditions, and the contractual relationship will be established (regarding such services) directly between the Service Provider and the participants/pax.
FFACT acts as a Principal, and may in certain instances act as an Agent when dealing with Service Providers.
FFACT is insured and detailed information can be provided on request.
BOOKINGS:
Quotes are either in South African Rands, or US dollars or Euros & subject to change.
Forex conversion and rate done at time of quote and is valid for 48hours. To secure that rate full payment will need to be made within 48 hours, otherwise price will be subject to forex fluctuations requiring new quote or payment in SA Rand.
Booking are subject to availability.
Bookings must be confirmed via e-mail by FFACT within one business day.
Our booking hours are: Mon-Sun 08h00 am to 17h00 pm Central Africa Time (GMT+2).
Any booking taken and confirmed by us will be undertaken.
Please contact us if your flight plans change (24 hours notification required).
Airport and/or single Transfer Rates are quoted for collection from pick up point to drop off point only. If multiple pick up and drop off points are required, this will be deemed as a chauffeur driven service and quoted accordingly.
In the event of a delayed flight we will monitor the situation and meet at the new arrival time, subject to the information provided by the Airport Company of South Africa (ACSA) flight information system. Should your flight be delayed by more than a 90 mins, due to reasons including but not limited to weather, airport closures, mechanical faults, technical problems or airport strikes, please try and contact us to advise the new arrival time.
If no ACSA flight information is available indicating a delayed or early arrival status, 60 minutes before a flight is scheduled to arrive, we will assume the flight will arrive on time.
Should you be delayed inside the airport terminal (Customs/luggage issues etc), please find a way to contact and inform us of the situation, ensuring the driver continue to wait for you.
It is your responsibility to contact the FFACT office/representative if you cannot locate your driver at the airport, or departure address, at the scheduled time. If you make alternate transport arrangements without contacting a FFACT representative, you will remain liable for all quoted fares.
Baggage – advise us if you have excess baggage where a trailer will be required.
A luggage trailer is available on request, subject to availability, and quoted for separately.
Baby or child booster seats are available on request, subject to availability, and quoted for separately.
Vehicles are subject to availability at the time of accepting the quotation.
Strictly no overloading of vehicles allowed.
Service excludes driver meals and accommodation unless indicated otherwise on the quotation.
HOURS OF OPERATION:
Chauffeur and Adventure Services, as well as driver hours, where the driver remains with the Client for consecutive hours, which may not be broken up, and are calculated from the point of dispatch to return to the dispatch, will be stipulated on the quotation.
Additional hours: are defined as hours, or part there off, where the service is provided within the original agreed period but the client has amended the agreed upon itinerary at the last minute, or where the service is extended beyond the agreed period at the insistence of the client. An after hours rate of R300/hour or part thereof will be billed at the discretion of FFACT. This rate is applied after the first 15 minutes of extended service, or in the event the vehicle has been dispatched and the client amends the collection time to a later time slot.
Waiting time will be charged at R150 per hour or part thereof, during normal day time business hours of 6am – 9pm South African time (9pm – 6am after hours rates of R300/hour apply), on the following:
– 90 minutes after international flight arrivals
– 60 minutes after domestic flight arrivals
– 30 minutes after scheduled shuttle departure for any other shuttles unless quoted otherwise or requested by you in which case we will charge R150 per hour for waiting.
No shows are defined as the client not arriving at the agreed pick up point within the above stated waiting period, and will come into affect according to:
– 150 minutes (2.5 hours) after international flight arrivals
– 120 minutes (2 hours) after domestic flight arrivals
– 60 minutes after scheduled shuttle departure
Additional kilometres: A rate of R10.00 per kilometre is applied to services where the actual kilometres travelled exceed the quoted inclusive amount e.g. where the client has requested for additional points, changed the drop off/collection, added additional points during the service, which may not have been originally provided for on the itinerary, or the itinerary provided by the Client was incomplete before the services took place.
PAYMENT TERMS:
For Standard Charter Services an invoice will be generated on written acceptance of the quotation and payment is required in full to confirm the booking.
For Adventure Charter Services an invoice will be generated on written acceptance of the quotation and a 100% payment is required within 48 hours to secure the booking.
Additional services or charges, not originally quoted for but incurred during the service, will be invoiced after the service has been rendered, and become payable on presentation of the invoice.
STANDARD CANCELLATION TERMS:
Cancellations must be verified and confirmed with FFACT in writing via e-mail. Bookings will remain valid and subject to all applicable charges and terms of service until you receive an e-mail confirmation from FFACT stating otherwise.
For chartered Adventure Services a minimum cancellation fee of 15% will be applied to any pre-reserved service if cancelled more than 7 days from the day of service. A 50% cancellation fee will apply if notified more than 2 days from the day of service, while a 100% cancellation fee will be applied in the case of a same day cancellations or no shows.
For Transfer Services a full refund will be applied to any pre-reserved service if cancelled 48 hours or more from the time of service. A 50% cancellation fee will apply if notified within 48 hours, while a 100% cancellation fee will be applied in the case of a same day cancellations or no shows.
Cancellation fees and/or terms may differ depending on the service required, service providers T&C’s and Cancellation Policies, type of special events etc, and these terms will be indicated in the body of the quotation and will override the standard cancellation terms listed here.
Where a subcontractor/service provider is used to render the services requested, their terms and conditions of service and cancellation terms will apply in conjunction with ours.
In the event of a full day cancellation by FFACT management, a full refund will be given on the amount paid, and no more. Partial refunds may be granted at the discretion of FFACT management.
In the event of a weather cancellation, FFACT management will judge the conditions and determine which/all activities need to be cancelled and what refunds need to be made. Service Providers cancellation terms will come into affect.
INDEMNITY CLAUSE:
All passengers are required to sign an indemnity form for all activities they are participating in prior to departure of the activity.
If a guest refuses to sign the indemnity form, the guest will not be able to partake in the activity.
The indemnity form must be signed by a Parent/Legal guardian for minors under 18 years.
Any unaccompanied child 18 or under requires the indemnity to be signed by a parent/legal guardian prior to the activity.
All persons entering an FFACT vehicle, and/or property owned by FFACT or under its control, do so entirely AT THEIR OWN RISK.
FFACT management reserves the right to refuse admission to unruly passengers who appear to be under the influence of alcohol or any banned substances.
FFACT is not liable for any loss or damages (including consequential or special damages or loss of profits), loss of life, bodily injury or damage to or loss of property of whatsoever nature and howsoever caused, and whether or not caused by FFACT, its directors, its officers, servants, agents or any other person acting on behalf of or under the control of FFACT, arising out of or connected in any way with the transportation or non-transportation by FFACT of any passenger or persons and/or their property.
Clients will be held responsible for any loss, or damage, caused to the vehicle, it’s fittings, or equipment either through negligence or misconduct. Damages incurred will be subtracted from the deposit and any additional or outstanding costs will be billed accordingly.
FFACT does not accept any liability for incorrect details supplied to us by the Client, resulting in complaints from passengers, delays, missed flights or any associated late arrivals. We shall not be liable for any loss or damage to baggage, personal possessions, or any indirect and/or consequential loss or damages (including loss of income or future income), including any other resulting consequences of any delays, missed flights, or late arrivals where the circumstances leading to the loss were out of our control.
FFACT vehicles are serviced and maintained to the highest levels, however in the unfortunate event of a breakdown FFACT cannot be held responsible for any inconvenience or loss of any kind.
FFACT shall not be liable for any loss or inconvenience caused by the early termination of our contracted services due to unruly behaviour and or any unforeseen circumstances outside of our control.
FFACT does not accept liability for any loss or damage caused, of whatever nature, by any failure to make advertised or perceived connections and/or transfers from one route to another or from one mode of transport and/or provider of passenger transport services to another.
FFACT is not liable in way for the failure of Service Providers to provide their service.
FFACT does not provide any insurance cover for passengers luggage, and passengers should ensure they are adequately insured against the loss or damage to their luggage.
Prices are subject to increases without prior notice.
These Terms of Service are subject to change without prior notice.

A 50% cancellation fee will apply if notified more than 2 days from the day of service, while a 100% cancellation fee will be applied in the case of a same day cancellations or no shows.
For Transfer Services a full refund will be applied to any pre-reserved service if cancelled 48 hours or more from the time of service. A 50% cancellation fee will apply if notified within 48 hours, while a 100% cancellation fee will be applied in the case of a same day cancellations or no shows.
Cancellation fees and/or terms may differ depending on the service required, service providers T&C’s and Cancellation Policies, type of special events etc, and these terms will be indicated in the body of the quotation and will override the standard cancellation terms listed here.
Where a subcontractor/service provider is used to render the services requested, their terms and conditions of service and cancellation terms will apply in conjunction with ours.
In the event of a full day cancellation by FFACT management, a full refund will be given on the amount paid, and no more. Partial refunds may be granted at the discretion of FFACT management.
In the event of a weather cancellation, FFACT management will judge the conditions and determine which/all activities need to be cancelled and what refunds need to be made. Service Providers cancellation terms will come into affect.
INDEMNITY CLAUSE:
All passengers are required to sign an indemnity form for all activities they are participating in prior to departure of the activity.
If a guest refuses to sign the indemnity form, the guest will not be able to partake in the activity.
The indemnity form must be signed by a Parent/Legal guardian for minors under 18 years.
Any unaccompanied child 18 or under requires the indemnity to be signed by a parent/legal guardian prior to the activity.
All persons entering an FFACT vehicle, and/or property owned by FFACT or under its control, do so entirely AT THEIR OWN RISK.
FFACT management reserves the right to refuse admission to unruly passengers who appear to be under the influence of alcohol or any banned substances.
FFACT is not liable for any loss or damages (including consequential or special damages or loss of profits), loss of life, bodily injury or damage to or loss of property of whatsoever nature and howsoever caused, and whether or not caused by FFACT, its directors, its officers, servants, agents or any other person acting on behalf of or under the control of FFACT, arising out of or connected in any way with the transportation or non-transportation by FFACT of any passenger or persons and/or their property.
Clients will be held responsible for any loss, or damage, caused to the vehicle, it’s fittings, or equipment either through negligence or misconduct. Damages incurred will be subtracted from the deposit and any additional or outstanding costs will be billed accordingly.
FFACT does not accept any liability for incorrect details supplied to us by the Client, resulting in complaints from passengers, delays, missed flights or any associated late arrivals. We shall not be liable for any loss or damage to baggage, personal possessions, or any indirect and/or consequential loss or damages (including loss of income or future income), including any other resulting consequences of any delays, missed flights, or late arrivals where the circumstances leading to the loss were out of our control.
FFACT vehicles are serviced and maintained to the highest levels, however in the unfortunate event of a breakdown FFACT cannot be held responsible for any inconvenience or loss of any kind.
FFACT shall not be liable for any loss or inconvenience caused by the early termination of our contracted services due to unruly behaviour and or any unforeseen circumstances outside of our control.
FFACT does not accept liability for any loss or damage caused, of whatever nature, by any failure to make advertised or perceived connections and/or transfers from one route to another or from one mode of transport and/or provider of passenger transport services to another.
FFACT is not liable in way for the failure of Service Providers to provide their service.
FFACT does not provide any insurance cover for passengers luggage, and passengers should ensure they are adequately insured against the loss or damage to their luggage.
Prices are subject to increases without prior notice.
